In the USA, are Black fraternities still legal? Why (or why not)?

In cl, we just did a case study on Affirmative Action, which is one program that seems to have run its course and is no longer really in play. I am a high school teacher, and my students just asked me about Black fraternities in the USA. I told them that, if they were still legal, they probably would not be for very much longer.
